LottoStar Online Terms and Conditions

1      General

1.1          LottoStar is licensed by The Mpumalanga Gambling Board and undertakes to abide by all the applicable laws, regulations and rules. The contract between LottoStar and the Player is made in terms of these laws. Players agree to abide by all legislated requirements,

1.2           The opening of an internet betting account and more particularly the conduct of betting transactions between LottoStar and its Players shall be exclusively governed by the Laws of the Republic of South Africa.

1.3           The Laws of the Republic of South Africa recorded in 1.2 are, inter alia, the following:-

1.3.1      the National Gambling Act No 33 of 1996 read with its regulations (as amended from time to time); and

1.3.2      the Mpumalanga Gambling Act No 5 of 1995 read with its regulations (as amended from time to time); and

1.3.3      the Financial Intelligence Center Act No. 38 of 2001 read with its regulations (as amended from time to time) (“FICA”); and

1.3.4      the Electronic Communications and Transactions Act No 25 of 2002 read with its regulations (as amended from time to time); and 3.3.

1.4           The Player warrants that they are 18 years old or older and eligible to gamble. LottoStar accepts no responsibility for bets placed illegally and the Player warrants that they are legally entitled to place bets with LottoStar from the jurisdiction in which they reside. It may be illegal for residents of some countries to bet with LottoStar and access to the website does not imply it is legal to bet online from any country.

1.5           The Player undertakes to notify LottoStar of any and all matters, including any change of personal information that might have a bearing on an approved registration.

1.6           If a Player is no longer able to read, understand, agree and comply with all LottoStar rules, policies and terms and conditions, without exception, they undertake to cease operating their LottoStar account immediately, and request LottoStar to close the account. LottoStar make no guarantees as to the availability of our website, markets or prices.

1.7           All content, text, examples, and rules on this website are the property of LottoStar (PTY) LTD and any unauthorized use or reproduction is prohibited.

1.8           LottoStar reserves the right to communicate with Players unless the Player has explicitly requested not to be communicated with.

1.9           The Player agrees to receive promotional emails/sms unless explicitly requested not to receive any promotional communication.

1.10        Money held by LottoStar in a Player account that is deemed to have been inactive for twelve months with no bets successfully placed, will be forfeited.

1.11        In the event that LottoStar believes a Player is abusing a bonus or promotion, displaying irregular betting behavior, or is likely to benefit through abuse or lack of good faith from a promotion offered by LottoStar, LottoStar may at its sole discretion withhold, deny or confiscate any bonus or promotion from the Player’s account. In this regard LottoStar shall be under no obligation to refund any funds other than your original deposit amounts.


2      Limitation of Liability

2.1        The Player represents and warrants that it shall indemnify and hold harmless LottoStar and its licensees, successors, related entities, directors, officers, agents, members; 3rd party contractors and employees and software provider (collectively, the “LottoStar Parties”) from and against any and all direct, general loss or damage, liabilities, losses, interest or penalties of whatsoever nature (whether direct, incidental, consequential, indirect or punitive damages)  incurred or sustained by the LottoStar Parties and any costs and expenses (including, but not limited to reasonable attorneys’ fees) from claims or actions against any of the Licensor Parties based upon or from any information, content, materials or communications transmitted, received, displayed, used and/or contained on or through the LottoStar Website and any and all transactions processed thereby; and/or any infringement or improper use by the Player of the LottoStar Service

2.2          The Player indemnifies LottoStar against any harm caused due to inaccurate information obtained from our website or employees, including but not limited to sports schedules, locations, prices, human error, computer malfunctions or results.

2.3         LottoStar reserves the right to cancel, at its discretion, any bet or transaction arising from such occurrence. LottoStar will not entertain any claims, and accepts no liability for losses sustained by a Player’s inability to access LottoStar markets or website, due to malfunction, cancellation of accounts, inability to provide markets, suspension of services or otherwise, regardless of the cause.

2.4            LottoStar may, at its sole discretion and without incurring liability of any kind, and at any time suspend the LottoStar service in whole or in part.

2.5         The Player indemnifies LottoStar against any loss caused by incorrect credits or debits to his account, including but not limited to, incorrect deposits or winning bet payouts. The Player authorises LottoStar to debit any amounts which have been incorrectly credited (through error, negligence or otherwise) to the Player account.

2.6           Without prejudice to any other provision of these Terms and Conditions, LottoStar shall not be liable to any person for:

2.6.1                        any event beyond its reasonable control including without limitation, any act of God, actual or threatened war or other threat or challenge to governmental authority, confiscation, nationalisation, requisition or destruction of or damage to property by or under the order of any Government or public or local authority, strike, lockout, industrial action, fire, flood, drought, tempest, power cut and/or failure or obstruction of any network, broadcasting or telecommunications service;

2.6.2                        for the failure of, or damage or destruction to, or any errors caused by the computer systems or records or any third party (including, without limitation, the Website), or any aspect of the foregoing;

2.6.3                        for delays, losses, errors or omissions in or made by the postal or other delivery service or by the banking system;

2.6.4                        for any other action or event that prevents or hinders the acceptance of a Bet;

2.6.5                        for the refusal to sell a Bet to any person or to allow any person to place a Bet; or

2.6.6                        for any losses caused to Players including misuse or unauthorised use of Passwords, money lost by placing Bets and failure or malfunction of the equipment or technology of the relevant Player or their Internet service provider.


3      Sign Up and Registration Procedure

3.1           In order to utilize the services provided by LottoStar, the Player will need to open an account. LottoStar reserves the right to reject any registration for a new account, and or cancel an existing account at its sole discretion, and without communication to the Player or applicant.

3.2         Players are only permitted one account and are specifically prohibited from opening multiple accounts in the name of or on behalf of other persons. LottoStar reserve the right to void any bets that they deem to have been placed by a single Player on multiple accounts.

3.3           New accounts are enabled for banking and profile updates only. LottoStar will verify an account holder’s identity and age before enabling bet placement on an account.

3.4          In terms of the provisions of the Financial Intelligence Center Act of 2001 it will be necessary for the Player to furnish LottoStar with a copy of the Player’s identity details (from an identity document/passport which must be valid) and proof of residence in the nature of a statement/invoice of account (rendered by a City Council or a bank in the case of mortgaged property) (which statements shall not be older than 3 (three) months). Should you have failed to comply with the provisions of FICA then LottoStar shall be prohibited from paying any credit balance in the Player’s account to the Player.

3.5           For further information in this regard please logon to www.fica.gov.za.

3.6           No withdrawals will be processed until all FICA requirements have been met

3.7           At all times the Player must ensure that its details in the opening account form remains up to date and to change any details that have altered since the date when the account was opened.

3.8           All Players are further required to supply their full names, residential address and at least one contact telephone number.

3.9           Players warrant that all information set out in the application form is true and correct.

3.10        Completion of the registration process implies that the Player has accepted and understood all of LottoStar’s terms and conditions. If the Player does not accept each and every term of this agreement, they are requested not to logon or open an account.

4      Betting

4.1            LottoStar will cancel and void any and all bets and return all money deposited to an account that LottoStar or the authorities deem to have been registered by or on behalf of an individual under the age of 18.

4.2            LottoStar exclusively reserves the right, at its sole discretion, to limit, reject and/or cancel any bets accepted and confirmed by LottoStar that is deemed to have been fraudulently; accidentally or erroneously placed.

4.3           LottoStar exclusively reserves the right, to limit, reject and or cancel any bets accepted and confirmed by LottoStar where LottoStar has either negligently, erroneously or otherwise offered or set incorrect prices, teams or event start times including but not limited to incorrect prices, teams or event start times.

4.4             Bets are only valid when accepted in accordance with all of LottoStar's rules, polices and terms and conditions.

4.5             LottoStar reserves the right to change or amend its rules, polices, terms and conditions at LottoStar's own discretion and without notice to Players.

4.6             If LottoStar suspects that match fixing has occurred, LottoStar reserves the right to withhold all funds on affected accounts and supply all account information to the relevant authorities and/or refund the relevant bets.

4.7         LottoStar reserves the right, and at its sole discretion, to choose the bet offering made available, including but not limited to: the events, markets, all betting options, odds, and the acceptance or refusal of any bets. LottoStar may make available or terminate betting offerings on any sports, events, markets and betting options at their sole discretion and reserves the right to make any changes without notice to the Player.

4.8          Players may not bet by any means not authorised by LottoStar, including but not limited to, robots and website or software manipulation. LottoStar reserves the right to cancel any bets deemed to have been placed by unauthorised means.

4.9        All bets and markets are subject to minimum and maximum stakes. The website will automatically adjust the stake on any bet that exceeds the maximum, prior to the Player submitting the bet. It is the Player’s responsibility to ensure that they are aware of any stake limit applied. All maximum stakes apply per Player, per bet and per day. The Player warrants that they will not attempt to deliberately exceed the stake limits and any bets placed in an attempt to avoid the application of these limits, including bets placed on accounts held by other Players and multiple bets placed on a single account in order to exceed the stake limit, will be voided at LottoStar’s discretion.

4.10        All entries placed for an event that has already past will either receive a full refund or placed into a future event.

4.11        A Player cannot claim any Winnings or payout from any games and may at its discretion decide about the validity of a Bet or a Player's entitlement to Winnings or void a Bet if:

4.11.1   Bets were placed after the relevant deadline or after the start of the relevant draw;

4.11.2   Bets were erroneously accepted after the relevant deadline or if the relevant drawing had already begun or taken place;

4.11.3   any games become aware of an error in relation to that Bet or draw and is not able to contact the player to correct the error or confirm the bet before the deadline;

4.11.4   the Bet was placed on behalf of a Player who has provided false information in connection with their Player Account or otherwise in connection with the Website or the services available through it;

4.11.5   the Bet was placed on behalf of a Player who has been involved in any fraud-related activities in relation to the placing of the bet, the operation of the Player Account or otherwise in connection with the Website or the services available through it;

4.11.6   the Bet was placed on behalf of a Player who was less than 18 years old or was a director, officer, or employee (or their spouse or dependant) of Any games or of one of the LottoStar Group companies;

4.11.7   the player maintains more than one Player Account;

4.11.8   in conjunction with any draw, fraud, technical and/or human error or unwarranted influence was found; or

4.11.9   the draw is declared by an organiser or co-organiser as being invalid.

4.12        All payouts advertised in foreign currency amounts are converted into Rand using xe.com. A player is eligible to win the Rand equivalent amount at the time of placing the bet, this amount is indicated on the bet slip and bet confirmation email.


5      Kwikie Games

5.1        Kwikie Games allow Players to participate in virtual games offered by LottoStar on the Website, with winning numbers drawn from the ZamLottery.

5.2        A Player may purchase between one and 100 games in pre-determined increments.The Stake is determined by the number of Kwikie Games purchased.

5.3        All Kwikie Game transactions are displayed in the “My Account” section of the Website.

5.4        LottoStar reserves the right to discontinue or to alter Kwikie Games formats, or add new Kwikie Games at its sole discretion, without providing reasons.

5.5        Each Kwikie Game consists of nine fields. If three fields show the same symbol or number-symbol, then the Player wins. Each Kwikie Games has a the same Stake, different payouts and a different payout table. The payout tables of all the Kwikie Games are displayed on each of the Kwikie Games “Game Info” tab.

5.6        Only one payout may be won per Kwikie Game bet, unless stated otherwise.

5.7        All numbers selected in our Kwikie games are on a Quick Pick basis and draw from the ZamLottery. In order to win the grand payout you will need to match all 3 numbers of the 3 ball sets; 3 of 10, 3 of 15 and 3 of 20. 5.8        If a purchased Kwikie Game/s is or are not played within a two week period, LottoStar reserves the right to play the Instant Win Game on behalf of the Player. Any Winnings will be paid out to the Player Account.

5.9        Once a player has selected the amount of bets and confirmed these, the bets are non-refundable and must be played.

5.10      Player Acknowledgement

5.10.1 Each Player acknowledges that he/she enters the Website and participates in the Kwikie Games provided at their own risk. Kwikie Gamesare provided without any warranty whatsoever, whether express or implied.

5.10.2   LottoStar shall not be responsible for any downtime, server disruptions, lagging, or any technical or political disturbance to the Kwikie Games. In the event of a malfunction, all Kwikie Games are void. Refunds may be given solely at the discretion of LottoStar.

5.10.3   The Player understands and acknowledges that if there is (or if the Player is later notified) that there is or has been a malfunction in the Kwikie Games or its interoperability, any Stake made during such malfunction shall be deemed invalid and the result, null and void, regardless of whether Winnings have been paid out. Winnings obtained by a Player in respect of a malfunctioning Kwikie Game shall remain the property of LottoStar. Any Stake from said Winnings played in any subsequent Kwikie Game/s round or rounds and the resulting shall also be deemed invalid and any result, null and void.

5.10.4   The Player is obliged to return any Winnings obtained under this clause immediately to LottoStar, whether or not upon demand.

5.10.5   To the fullest extent permitted by law, LottoStar respectively disclaims all liability for any cost, expense loss, damage, claim and/or liability to the Player or any third party, howsoever arising, in relation to the Website or its content, or the Player’s use of the Website or participation in any Kwikie Games; including without limitation, delays or interruptions in operation or transmission, loss or corruption of data, communication or lines failure, any person's misuse of the site or its content or any errors or omissions in content.


6      Banking - Deposits

6.1        Players must register with LottoStar before making a deposit to their accounts.

6.2        Deposits to betting account may be made by credit card or EFT. Payments must be from a credit card or bank account in the name of the Player name. LottoStar do not accept cash deposits as we are unable to verify the identity of the depositor.

6.3        Money deposited to a LottoStar account is held by LottoStar on the client’s behalf until it is used to place a bet.

6.4        All winnings are returned to the Player’s LottoStar account.

6.5        LottoStar reserves the right to charge transaction fees, including but not limited to an amount equal to any credit card transaction fees.

5.6     LottoStar reserves the right to charge any fees incurred where a player has made a deposit via one payment option and a withdrawal via another with no or a few betting transactions having been placed in comparison to the players deposit amounts. A player's account will be suspended and any fees for deposits and withdrawal that LottoStar incurs will be charged to players account.


7      Banking – Withdrawals

7.1        For EFT deposits LottoStar will require either a bank generated fax or email confirmation of your payment showing the account name before we will process a withdrawal.

7.2        Withdrawals from a betting account will only be made to a bank account in the name of the Player.

7.3        LottoStar will only pay out to South African bank accounts in South African Rands.

7.4     Any bank charges relating to the withdrawal of winnings to a foreign bank account (Non South African account) will be for the account of the client/account holder.  The bank charge will not be deducted from the winnings but the client’s bank account will merely be debited with the bank charges in respect of the foreign monies coming into his/her account.  

7.5        For withdrawals of R25 000 or more LottoStar require the Original FICA documents both of which need to be certified.

7.6        Payments will be processed on any weekday, excluding public holidays, subject to 24hrs notice to effect payment. LottoStar may withhold payment pending receipt in its bank account of all money paid to LottoStar by the Player.

7.7        LottoStar reserves the right to charge transaction fees, including but not limited to an amount equal to any credit card transaction fees, if Lotto is of the belief that the Player deposited money and not used the account for legitimate betting purposes.

7.8        The Minimum Withdrawal amount is R100.

7.9        Money held in a LottoStar account may be refunded on request, subject to 24 hours’ notice to enable LottoStar to verify that all of the Terms and Conditions have been complied with.

7.10     LottoStar reserves the right to withhold a withdrawal of monies where money laundering is suspected. An inspection will begin on the account and all fees incurred in processing transactions will be charged to the players account. 


8      Security Policy

8.1        LottoStar secures all Player information, both online and offline.

8.2        All data is transmitted using SSL encryption.

8.3    The Player is solely responsible for the safekeeping of his login, password, security details and account details. The Player indemnifies LottoStar against any claims, losses or damages arising from unauthorized use of his or her account. Unauthorised transactions on a Player account will only be cancelled at LottoStar's discretion.


9      Player Data Privacy Policy

9.1           All information supplied is strictly confidential, and the Player agrees to the LottoStar privacy policy.

9.2       The Player consents to checks being made against appropriate 3rd party databases to verify identity, personal details or credit card information, and any other information supplied by the Player that LottoStar deems necessary to acquire independent verification. The parties with which LottoStar contracts for the verification of information may keep records of all data requests and data submitted to them by LottoStar.

9.3        All Player personal information is stored securely by LottoStar and will not be shared with 3rd parties, other than information required to process 3rd party checks and payments, which will be transmitted securely to  LottoStar’s processors. Players acknowledge that LottoStar will be required to supply their personal details and transaction records to The Mpumalanga Gambling Board and any other statutory body that legally requests access to the data. The Player acknowledges that although every endeavour has been made to ensure Player data privacy, LottoStar makes no guarantees, and will to the best of our ability ensure such information supplied by a Player is not made available to any third party except as required to by law.

9.4        The Player consents to the recording of all telephone conversations with LottoStar.

9.5        LottoStar tracks and stores information about Players’ use of the website, including the IP address of the computer used to place bets. If you require access to information on what data is held about you, this can be obtained by contacting us (in accordance with the Promotion of Access to Information Act No. 2 of 2000).


10      Delivery Policy

10.1        A confirmation message will be displayed on the website and an email sent to the Player’s email address when a bet has been placed successfully. Bets are deemed to have been accepted as soon as they have been registered on our systems and a transaction has been processed against the Player’s betting account, regardless of whether or not the confirmation message is received by the Player.

10.2        All bets accepted after the official start of an event will be void, unless the event is specifically labelled as being available for betting in running.

10.3        The Player is solely responsible for ensuring that bets are placed accurately. Bets cannot be cancelled by the Player once accepted by LottoStar.


11   Intellectual Property

11.1     The Player or any other party shall have no right to copy, in whole or in part, the LottoStar Product, software and website and shall not modify, adapt, translate, reverse engineer, decompile, disassemble, re-distribute, re-sell or create derivative works based on the LottoStar Product.


12   Dispute Resolution

12.1   Whenever LottoStar refuses to pay alleged winnings to a Player or a Player refuses to pay an alleged debt to LottoStar, for any reason, and LottoStar and the Player are unable to resolve the dispute to the satisfaction of both parties:

12.2   LottoStar will inform the Player that the dispute will be referred to the Board for resolution, after which LottoStar will, within forty-eight hours, refer the dispute to the Board.

12.3   The Player is not precluded from lodging a complaint directly with the Board.

12.4   The Board shall conduct whatever investigation it deems necessary to resolve the dispute and shall serve a written notice on LottoStar and the Player, informing them of the Board’s resolution.

12.5   The resolution of the Board shall become effective on the date when the parties receive a written notice of the resolution.


13   Promotions, Bonuses or Special Offers

13.1   All promotions, bonuses or special offers are subject to promotion-specific terms and conditions and any bonus and/or promotion must be used in adherence with such terms and conditions in order to be eligible to receive the bonus or the promotion.

13.2   LottoStar reserves the right to withdraw any promotion, bonus or special offer at any time. In the event that LottoStar believes You are abusing or attempting to abuse a bonus or other promotion, or are likely to benefit through abuse or lack of good faith, then LottoStar may, at its sole discretion, deny, withhold or withdraw from the player any bonus or promotion, or rescind any policy with respect to the player, either temporarily or permanently, or terminate and/or block the player’s access to LottoStar’s services and products without being under any obligation to pay the player any amount (even winnings generated from the use of such promotion, bonus or special offer). In the event of subsequent errors or omissions in promotional material, bonuses or any special offers, LottoStar reserves the right to withdraw, adjust or correct any and all errors and omissions.

13.3   LottoStar reserves the right to prevent Users registering, logging in or depositing from certain jurisdictions or from participating and being eligible for any or all promotions and bonuses, at the LottoStar’s sole discretion.

13.4   The provisions of this section 13 apply to all kind of bonuses, promotions and benefits granted to a Player in excess of the actual deposit made by the player.

13.5   Any bonus and/or promotion received must be used within 30 days from the date in which such bonus and/or promotion is received; after such 30 day period, the LottoStar will withdraw any part of the bonus and/promotion not used and the player will not be entitled to such part of the bonus and/or promotion.

13.6   The Player agrees to abide by the terms and conditions of any bonus offer or competition offered by LottoStar. LottoStar reserves the right to alter or amend the terms and conditions of any bonus offer or competition at any stage and at its absolute discretion, whether or not the Player has already taken any action as a result of a bonus offer or competition, including depositing money to their account or placing bets. The Player warrants that they will not take any action that could be construed as bonus offer or competition abuse, in particular to gain any financial advantage not specifically intended by LottoStar.

13.7 All KINO (10, 12, 14 & 15) double payout weekend promotions are applicable to top tier payouts only. 


14   Wagering

14.1   A Player’s total account balance consists of a Cash Account and a Bonus Account. Withdrawals cannot be made from the Bonus Account, but the Bonus Account can be used to place wagers. You will be unable to withdraw any amount from your account until you’ve either met the wagering requirements or played through all funds in the Bonus Account.

13.2 Minimum wagering requirements are set at ten (10) times the cumulative amount of your purchase and bonus received before a withdrawal can be made. Eg: deposit R100, if a player receives R30 free, the player must wager R1300 (10 x R130) before requesting a cashout. 


15   Winnings

All winnings must be claimed within ninety (90) days of allocation thereof, failing which they will be forfeited.


16   Cut-Off Times

Cut-off time for bets is one hour before the official draw to allow for sufficient processing, this is applicable to all major lotteries.


17   Competition

All competitions run from Monday to Friday. All entries submitted during the weekend will be entered into Monday's draw.

The Player warrants that they have read, understood, accepted and will comply with all LottoStar's terms and conditions.
